BOOKING TERMS AND CONDITIONS
1. Terms Used
NAVETIERRA KM 0 SOCIEDAD ANONIMA together with SERVICIOS TURISTICOS ROLLING
HOSTEL LIMITADA are referred to hereafter as the Companies.
2. Booking
To make a definite booking to any tour, the participant should fill up the on-line
booking form and make a 100 Euro deposit. The rest must be paid 45 days before
the tour starts.

Once we received your on-line booking form and your deposit we'll confirm your
booking by e-mail within 72 hours (allowing for weekends).
3. Cancellation
In the case that the Client cancels his/her participation the following policy
of retention will be applied:
between 43 and 56 days before departure: 40% of the holiday cost
between 29 and 42 days before departure: 60% of the holiday cost
between 15 and 28 days before departure: 80% of the holiday cost
14 days or less before departure: 100% of the holiday cost.
4. Services
The Companies have no responsibility in whole or in part for any delays, delayed
departure or arrival, missed carrier connections, loss, damage or injury to
person or property, mechanical defect, failure, or negligence of any nature,
howsoever caused, in connection with any accommodations, transportation, or
other services, or for any substitution of hotels or of common carrier equipment
beyond their control, with or without notice, or for any additional expenses
occasioned thereby. The Companies reserve the right to use alternative forms
of transport and/or vary the itinerary if force majeure, breakdown, accident,
sickness, etc. make such a change necessary. Force majeure is war, threat of
war, riot, civil strife, industrial dispute, terrorist activity, natural or
nuclear disaster, fire or adverse weather conditions, technical or maintenance
problems with transport, changes imposed by cancellation or rescheduling of
flights by an airline or main charterer, the alteration of airline or aircraft
type, or other similar events beyond the control of the Companies. The Companies
are not liable for any penalty charges associated with non-refundable airfares.
Reasonable changes may be made in the itinerary because of the weather conditions
or if judged to be in the best interest and well being of the participants.
The right is reserved to substitute hotels, alter the itinerary, and reverse
the order of the places to be visited.
5. Insurance
Travel insurance is mandatory for all Clients whilst on a tour organised by
the Companies. Clients together with their personal property including baggage
are at all times solely at their own risk. Clients are wholly responsible for
arranging their own insurance. A suitable insurance policy should provide adequate
cover for medical expenses arising through illness or accident prior to or during
the holiday and loss of holiday monies through cancellation or curtailment of
the holiday for insurable reasons. The local vehicle insurance includes only
limited passenger accident liability or none at all. Clients making their own
insurance arrangements should ensure that there are no exclusion clauses limiting
protection for the type of activities in their tour. Proof of adequate insurance
will be requested at the start of your tour, failure to provide this will result
in the Client being prevented from joining the tour.
6. Passports, Visas and Vaccinations
It is the responsibility of the Client to be in possession of a valid passport,
visa permits, vaccinations and preventative medicines as may be required for
the duration of the tour. Information about these matters or related items is
given in good faith in the tour dossier but without responsibility on the part
of the Companies.
7. Age, Fitness and Participation
All Clients are expected to satisfy themselves prior to booking that they are
fit and able to complete the itinerary of their chosen tour as described in
the tour dossier. Clients are also expected to accept that the tours described
are Adventure Holidays and that travel to and facilities in developing countries
will not be to similar standards which they may be accustomed to at home, we
do not provide luxury holidays. Persons over 60 years of age may be asked to
provide medical evidence of fitness to travel on certain itineraries. No unaccompanied
minors (those under 18 years of age) can be accepted on tours operated by the
Companies. However teenagers may be considered provided they are accompanied
by a parent or guardian who accepts full responsibility for them. The Companies
reserve the absolute right to decline a booking at their discretion. Clients
agree to accept the authority and decisions of the Companies employees, tour
leaders, and agents whilst on tour with the Companies. If in the opinion of
such person the health or conduct of a Client before or after departure appears
likely to endanger the safe, comfortable or happy progress of a tour the Client
may be excluded from all or part of the tour. In the case of ill health the
Companies may make such arrangements as it sees fit and recover the costs from
the Client. If a Client is excluded from the tour as above or chooses to leave
the tour of their own free will or leaves the tour due to ill health or any
other reason there will be no refund of the tour price, extra services, surcharges,
local payments/funds or any local surcharges. All services forming part of the
whole package booked will be forfeit though may be recoverable through your
personal travel insurance in some circumstances.
8. Local Laws
All participants in tours operated by the Companies are expected to obey the
laws and regulations of the countries visited and any failure to do so will
relieve the Companies of all obligations that they may otherwise have under
these booking conditions.
9. Illness or Disability
Anyone suffering from illness or disability or undergoing treatment for any
physical or medical condition must declare the true nature of such condition
and make arrangements for the provision of any medication or other treatment
which may be required during the tour. Failure to make such disclosure will
constitute a breach of these booking conditions and result in such persons being
excluded from the tour in which case all monies paid will be forfeit.
10. Equipment
Each participant is responsible for the equipment that the Companies give him,
and must pay for any damage or loss.
11. Publishing material
The Companies reserve the right to publish any pictures, videos and any graphic
material of the tour and its participants.
12. Our reponsabilities
The tours operated or supplied by the Companies have been designed to provide
participants with an exposure to the true nature of the environment visited
and therefore involve an element of personal risk and exposure to potential
hazards over and above those associated with normal ‘package’ holidays.
All bookings are accepted on the understanding that such risks and hazards are
appreciated by the Client and that they undertake all tours, treks, optional
excursions and other activities at their own volition.
a) All information in the tour dossier and on our website has been compiled
with reasonable care and is published in good faith. It is not issued on behalf
of, and does not commit any airline or ferry company whose travel arrangements
form part of the tour. In circumstances where the Companies are acting as agents
only - e.g. when making arrangements locally (i.e. in the course of any tour)
it does so on the express condition that it is not liable for any additional
expenses, loss, damage, injury or breaches of contract whether negligent or
otherwise howsoever caused arising directly or indirectly from the actions or
omissions of the supplier or independent parties with whom the arrangements
are made.
b) The Companies accept no liability:
i) If there has been no fault on the part of the Companies or its suppliers
and the cause was your own fault, or the actions of someone unconnected with
the provision of your tour which actions were unforeseeable or unavoidable,
or unusual and unforeseeable circumstances beyond the Companies control, the
consequences of which could not have been avoided even with the exercise of
all due care or something which the Companies or any supplier of services, even
with all due care could not have been foreseen or forestalled.
ii) In cases of personal liability, injury or death in circumstances when the
client has been participating in any activity which does not form part of the
original arrangements booked through and contracted with the Companies, even
though they may have been supervised, arranged or recommended by the Companies
or its representatives. Examples are mountain, rock or volcano climbing, trekking,
bicycling, mountainbike, horse riding, glacier trekking, skiing, canoe and rafting
trips, bungi jumping, diving, snorkelling, paragliding, sandboard, ballooning
or any other activities of a risky nature.
iii) In cases of disease or illness contracted during or after the tour.
iv) For any information or advice given to you by your travel agent unless it
has been given to the agent by the Companies. Otherwise, such information and
advice is the responsibility of the travel agent.
v) For your travel agent not giving, or incorrectly giving you advice, information
or documents which the Companies has sent or given to your travel agent.
vi) For any information and advice on visas, travel documents, climate, spending
money and other costs, clothing, equipment, etc. All such information and advice
has been compiled with reasonable care in the tour dossier and is given in good
faith but without responsibility on the part of the Companies.
vii) For your personal belongings while in the sight of yourself or other group
members, or while under the care of airlines or airports.
viii) For any information or handouts given by trip leaders. Such information
is given in good faith but without responsibility on the part of the Companies
or its local agents.
c) Where the Companies supplies air transportation (either directly or through
an agent), its responsibility in respect of air travel is limited to the airlines'
conditions of carriage. The responsibility of the airlines is similarly limited
to the carriage of passengers and baggage in accordance with their conditions
of carriage.
d) The Companies cannot accept any liability for any delay or cancellation in
your flight to the joining point of the land tour or returning from the end
point of the land tour, whether the delay or cancellation is caused by adverse
weather conditions, rescheduling by an airline, airport authority and/or action
by air traffic controllers, mechanical breakdown or industrial action.
e) The Companies, their employees and agents accept no responsibility or liability
for expenses, inconvenience, loss of enjoyment or anything else caused by non-compliance
with any of the Client's responsibilities listed in these booking terms and
conditions.

This Agreement shall be governed in all respects by and interpreted in accordance
